Am I entitled to a solicitor at the police station?

When arrested, you have three specific rights, one of which is that you have a right to free legal representation.  We can offer you that legal representation at no cost to you.  The Legal Aid Agency fund our services; and we have a number of highly qualified and experienced police station representatives to assist you at all stages of the police station process.

When do I tell the police I have a solicitor?

When you arrive at the police station the police will confirm your right to legal representation. Once you let the police know that you would like a solicitor present, they will ask you whether you have a nominated solicitor or whether you would like a duty solicitor.

At this point you can advise them that Hayes Law are your nominated solicitors and that we should be contacted.  Provide them with our details and we will get to the police station as soon as possible.  We can also provide initial advice over the phone when you are arrested, allowing you to be as prepared as possible in the circumstances.

What if I am arrested outside normal hours?

We are available 24 hours a day.  Should you be arrested outside of normal working hours simply contact our emergency number on 0771 760 6639.  Provide the police with this number when they ask you about your solicitors and we will turn up as and when you need us.

Why do I need a solicitor at the police station?

It is in your best interests to have a solicitor present at all stages of the police station process.  When you arrive in the police station you will often be asked to provide samples of DNA, fingerprints, blood or other more intimate samples.  You do not have to consent to all of these and if you consent it could adversely affect your case.

We can advise you on the legal implications in respect of samples.  If interviewed at the police station, we can advise you the best way to proceed at interview.  We have the experience to advise you so that you are in the strongest position possible when you leave the police station. In addition we can also make representations to the police on your behalf in terms of the granting of bail and the potential resolution of your case by way of a caution.

 How much would my case cost?

At the police station you are entitled to free legal representation, you will therefore not have to pay.

Should your case progress to a court hearing, depending on the nature of the offence as well as your income levels, you may be entitled to Legal Aid.  Should you not be eligible for Legal Aid, the firm has formulated a range of fixed price services.

I need to return to the police station but had no solicitors/different solicitors last time. Can Hayes Law represent me in this situation?

If you were unrepresented on the previous police station attendance that does not mean you are unable to have a solicitor the next time you attend.  If this is the case then please contact us as soon as possible so that we can make sure we allocate a police station representative to represent you.
