Hayes Law News update

Since the last news update we would like to welcome new additions to our criminal practice team in Eastleigh Nicola Attwood, Ben May and Janine Pengelly. Nicola is a highly experienced duty solicitor and HCA. Ben joins us from practice in London and Janine moves into enhance our team as a highly experienced administrator.
 
Nigel Cozens is now head of the Eastleigh criminal practice having become a Partner in the the new LLP. The restructuring and development significantly improves the quality and experience of the practice.
 
We would also like to congratulate Alexis Hager on obtaining her High Court Advocates Qualification (Criminal).
 
Since the last news update we would like to announce and welcome Nigel Cozens to our Criminal law practice in Eastleigh. Nigel is a highly experienced and respected criminal litigator with a specialism in police station and magistrates court work.
 
We would also like to welcome back to our Hammersmith office Criminal Practice Lynne Gothard.
 
You will note that the Hammersmith office has now moved into new premises with effect from 5th January 2009. The move has been welcomed by staff and clients alike as the premises are a vast improvement on the old offices.
 

Case Update

There have been a few notable developments.
 
Audrey Osborne (as solicitor) and Julian Hayes (as Junior advocate) led by Mr. Toby Hedworth QC recently represented Glen Rycroft at his murder trial at the Old Bailey [Daily Mail | The Times Online]. The case is now the subject of an appeal.
 
We can report that Mulu Girma was successful in her appeal against sentence having her 10 year sentence reduced to 5 yeas. Mulu and her family have strenuously denied any involvement and subsequent concealment of information in the aftermath of the 21/7 attempted bombings. The appeal against conviction is now being reviewed by her legal team [Sky News].
 
Spain v- Gary Owen - you will recall Mr Owens attempts at fighting the Spanish Governments extradition warrant. The matter was appealed to the Court of Appeal but was rejected. His case was appealed to the newly formed Supreme Court and had the dubious honour of being the first case registered with them for appeal. Unfortunately the Supreme Court have rejected his appeal and he has now been extradited to Spain. We are currently assisting with his defence in Spain and have obtained the assistance of the lawyers who successfully defended another client of ours, Hedi Ben Youseff Boudhiba.
 
Julian Hayes has recently been involved as Junior Advocate in the recent case of R ­v- Fields and others. It first murder case to be prosecuted where the victim has been alleged to have been frightened to death. After some legal argument as to the admissibility of some of the Crowns medical evidence the prosecution had to concede that they had insufficient evidence to establish the murder allegation. Spain ­v- Gary Owen ­ after 3 days of evidence and legal argument the City of Westminster magistrates court have ordered the extradition of Mr Owens to Spain to face charges of murder and robbery. This is an unusual case in that the offences alleged date back to 1991. Mr Owens spent over 2 years in custody in Spain before returning to this country. The decision by the magistrates will be appealed.
 
Julian Hayes has recently been instructed by Mulu Girma to represent her on her appeal against conviction and sentence. Mulu and her family have maintained and strenuously denied any involvement and subsequent concealment of information in the aftermath of the 21/7 attempted bombings. It is anticipated the appeal will be heard in spring/early summer of this year.
